Acceptance of the Terms

These Terms and Conditions (hereinafter, the "Terms") govern access to and use of Programando Web, a platform owned by xlRaiko. Registering on the platform, as well as merely using its public features, implies full acceptance of these Terms and of the Privacy Policy.

If you access or use the platform on behalf of a minor in your care, you confirm that you have the capacity to authorize such use as set out in section 4.

Definitions

Service Description

Programando Web is a free educational platform dedicated to learning programming and web development. Among other things, it offers the following services:

• Programming tutorials and lessons structured by category and difficulty.
• Gamification system with experience points (XP), levels and achievements.
• Programming-related mini-games (Battleship, Tetris, TicTacToe).
• Global community chat and private messages between users.
• Assignment system with submission and grading.
• Built-in AI Assistant.
• User ranking and friends system.

The service is provided free of charge. Programando Web reserves the right to introduce optional paid features in the future, which will in no case affect the essential educational content already available, and which will be announced with reasonable notice.

Registration Conditions

Creating an account is required to access most features. By registering, you declare and accept that:

• The information provided is truthful, accurate and up to date.
• You are 14 years of age or older or have the consent of your parent or legal guardian.
• You are the holder of the email address you provide.
• You will not create more than one account per person. Duplicate accounts may be deleted without prior notice.
• Your username (nickname) does not contain offensive or discriminatory language, third-party trademarks, or third-party personal data.
• You are responsible for keeping your password confidential and for all activities carried out from your account.

Permitted Use and Prohibited Conduct

Programando Web is an educational and collaborative space. These are the lines that separate proper use from misuse of the platform:

Moderation and Sanctions System

Programando Web has a moderation system to ensure a safe and respectful environment. Sanctions are applied progressively according to severity and repeat offenses:

Moderation decisions are made by the administration team. If you believe a sanction is unfair, you can contact us by email to request a reasoned review.

Intellectual Property

Platform content: all texts, tutorials, images, source code, logos, design, mini-games and other original elements of Programando Web are the property of their creators and are protected by applicable intellectual property laws. Their reproduction, distribution or commercial use without express authorization is prohibited.

User-generated content: by publishing content on the platform (messages, comments, assignment solutions), you retain ownership of it, but you grant Programando Web a non-exclusive, free, worldwide license to display that content within the context of the platform, including its storage, display and moderation.

Third-party trademarks: the names and logos of Discord, Google, Instagram, X (Twitter) and other mentioned services are registered trademarks of their respective owners. Their mention does not imply affiliation with or endorsement by those brands.

Infringement notices: if you believe any content on the platform infringes your intellectual property rights, contact us describing the infringement and we will review it and, if applicable, remove it.

AI Assistant

Programando Web includes an AI assistant to help users with their programming questions. By using it, you accept that:

• The assistant's answers are for guidance only and may contain errors. They should not be taken as definitive professional advice.
• You must not use the assistant to generate harmful, illegal content or content that infringes third-party rights.
• Conversations with the assistant may be reviewed by the team to improve the service, always in accordance with the Privacy Policy.
• The assistant does not replace your own learning; it is meant to complement it, not as a shortcut to avoid personal effort.
• Misuse of the assistant (for example, attempting to generate prohibited content) may lead to the sanctions described in section 6.

Gamification System

The XP, level, achievement and ranking system of Programando Web is a platform feature designed to motivate learning, not an asset with monetary value. Therefore:

• Programando Web may modify, readjust or remove scores, achievements or levels at any time, especially to correct abuse or system errors.
• Points and achievements cannot be redeemed for money nor transferred to other platforms or accounts.
• The loss of XP, achievements or ranking position resulting from a sanction for breaking the rules does not give rise to any claim or compensation.

Availability, Modification and Suspension of the Service

Programando Web reserves the right to:

• Modify, expand or reduce the platform's features at any time.
• Temporarily suspend the service for maintenance tasks, trying to minimize the impact on users and giving notice when possible.
• Permanently close the platform, giving notice at least 30 days in advance through the website itself and, where applicable, by email.

We do not guarantee uninterrupted availability of the service, although we work actively to maintain as much uptime as possible.

Limitation of Liability

Programando Web is provided "as is", with no guarantees of continuous availability or absence of errors. Specifically:

• We are not liable for service interruptions due to maintenance, technical failures or force majeure.
• We are not responsible for content posted by users in chat or other interactive areas.
• We do not guarantee that the educational content is always up to date with the latest versions of the technologies covered.
• We are not liable for damages arising from the use of the AI assistant or the incorrect application of the tutorial content.
• We are not responsible for third-party websites linked from the platform.

Nothing in this section excludes liability that cannot be legally limited under Spanish consumer protection regulations.

Account Deletion

You can request the deletion of your account at any time by contacting us by email. After the request:

• Your profile, activity history and messages will be deleted or anonymized within a maximum of 30 days.
• Technical access data will be retained for 3 months for security reasons.
• If your account was permanently banned, the record of that sanction may be kept to prevent further abusive re-registration.

Programando Web may also delete accounts that have been inactive for a long period, with prior email notification when possible.

Sponsors and Advertising

Programando Web may display sponsor company logos in the footer or other sections. These sponsorships:

• Do not influence the educational content or the moderation of the platform.
• Are indicated clearly and transparently.
• Do not imply that Programando Web specifically endorses or recommends those sponsors' products or services.

General Provisions

14.1 Data protection

The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

14.2 Force majeure

Programando Web will not be liable for any failure to fulfill its obligations when due to force majeure, including failures of external hosting or connectivity providers, cyberattacks or natural disasters.

14.3 Severability

If any clause of these Terms is declared void or unenforceable, the remaining provisions will retain their full validity and effect.

14.4 Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between the user and Programando Web regarding the use of the platform, and supersede any prior agreement on the same subject.

14.5 Assignment

Programando Web may assign or transfer its rights and obligations under these Terms in the event of restructuring, sale or transfer of the platform, informing users when appropriate. The user may not assign their account or their rights under these Terms to third parties.

Modification of the Terms

We may update these Terms at any time. When changes are relevant, we will communicate them via a notice on the platform or by email at least 15 days in advance. Continued use of the platform after the new Terms take effect implies their acceptance.

Applicable Law and Jurisdiction

These Terms are governed by Spanish law. To resolve any dispute arising from the use of the platform, the parties submit to the Courts of the user's domicile, without prejudice to the rights that consumer protection regulations grant to users.
